Bryan Butts, 24, of Oxford was charged with capital murder, according to Oxford police Chief Bill Partridge.
On May 3, Oxford Emergency Medical Services received a call around 7:13 a.m. to a home on the 4000 block of Pecanwood Drive within the Oxford City limits of Talladega County. Inside, they found 2-year-old Cody Allen Rollins, who was unresponsive. The toddler was taken to Regional Medical Center.
An emergency room doctor pronounced Rollins dead at 8:10 a.m., Talladega County Coroner Shaddix Murphy told The Star.
Partridge said Rollins died of blunt force trauma, most likely from Butts’ fists. No other weapons were reportedly involved, the chief said.
Butts was dating Rollins’ mother when the incident occurred, Partridge said. The residence on Pecanwood Drive belonged to Butts and Rollins was reportedly living there with his mother.
Partridge said investigators have been working on the case nonstop since last Friday.
“They’ve spent long hours building a case,” the chief said.
Butts was in the Oxford City Jail this afternoon, Partridge said. No bond is set.
A court appearance is scheduled for May 10 at 10 a.m. at the Talladega County Courthouse.
