Police charge man with choking his girlfriend

Police say an Anniston man charged with felony domestic violence threw his girlfriend against a wall and choked her at their home earlier this month, a crime more serious than he’d first been charged with in the incident.

Ralph Toney, 41, was first arrested Aug. 8 after police responded to a distress call on the 4700 block of Eulaton Road, according to Anniston police Capt. Allen George.

George said Toney and his 48-year-old girlfriend were arguing when Toney pushed her against the front of their home and strangled her. A police report did not mention what they were arguing about, the captain said.

When officers arrived, they arrested Toney on a third-degree domestic violence charge even though the victim told police she had been choked, George said.

The victim, who was treated at the scene by Anniston firefighters, suffered from bruising to her throat and a cut on her right earlobe, the captain said.

Toney was placed in Anniston City Jail Aug. 8 on misdemeanor charges of domestic violence. He was released on a $500 bond Aug. 17, George said.

George said investigators realized police had misinterpreted the charges and obtained a felony arrest warrant from district court on Aug. 22. The current charge is domestic violence-strangulation.

George said that Toney, having learning from family members that police were looking for him, called the police Thursday from a home on the 3300 block of Truman Avenue, where he was arrested on the new charge.

Toney was released on a $15,000 bond this afternoon. His court date is set for Sept. 30.
