No verdict yet in trial of man charged with 2010 murder

After more than eight hours of deliberation, a Calhoun County jury will reconvene Friday to decide whether an Anniston man is guilty of murder in the 2010 stabbing death of his co-worker.

The jury reconvened this morning and deliberated until 4:30 p.m. Deliberations had begun Wednesday afternoon and continued into the early evening.

Calhoun County Circuit Judge Bud Turner said today that despite the toll the trial has taken on jurors, he would not declare a mistrial.

“I know you didn’t volunteer for this job, but it’s a job you have to do,” Turner told the jurors.

On Friday, the jury will likely decide what crime, if any, 38-year-old Anniston resident Terrence Lamont Allen should be convicted of in the death of Dimir Ranz Burton, 39. According to prosecutors, Allen stabbed Burton in the head after a Sept. 14, 2010, altercation at the Car Exchange on Quintard Avenue, where both men worked.

Allen and his attorney, David Johnston, say Allen acted in self defense while prosecutors say Allen had the opportunity to walk away from the incident.

Calhoun County Assistant District Attorney Randy Moeller said hours of deliberation are not uncommon in cases when there is a question whether the defendant is guilty of murder or manslaughter.

This morning, the jury requested that Turner reiterate what constitutes manslaughter and what constitutes self defense.

Allen faces 20 to 99 years or life in prison if convicted of murder. The minimum sentence could drop to 10 years if the jury finds him guilty of manslaughter.

Johnston declined to comment after court adjourned today, saying it would be more appropriate to make a statement once the jury makes a decision.
