New hearing set in tree trial

A motion filed by the lawyers for Alabama Power Company on April 17 was answered by Judge John C. Thomason yesterday as he set a hearing date for June 16 to hear arguments regarding whether or not Rufus Kinney and Barbara Wilson were justified in filing for an injunction against the utility company.

Also among the issues discussed in Alabama Power's motion is whether or not Thomason's ruling in March followed the rule of law in saying the past practices of Alabama Power in trimming trees, rather than cutting them down, dictated how their franchise agreement with the city of Jacksonville should be interpreted.

Mark Martin, attorney for Kinney and Wilson, said he wasn't surprised by the filing.
